WINS PUBLIC PRIVATE PARTNERSHIP AWARD
Each year, the National Council for Public-Private Partnerships (NCPPP) undertakes and completes the selection process for the outstanding leadership and projects in the field of public-private partnerships (PPPs). These awards recognize exemplary projects and services that illustrate the best practices and innovative approaches in the use of PPPs.
The US. Army Enhanced Use Leasing Program, Chevron Energy Solutions and Keenan Development Associates, for the National Inter-Agency BioDefense Campus’s high-quality and secure utilities project were selected for NCPPP “Infrastructure Award”.
Michael Simmons and Tony Kushnir acted as legal counsel to the Developer/Facility Owner/Enhanced-Use Lessee, Keenan Development Associates, LLC.

The transaction involves an Army ground lease of a parcel of vacant land at Ft. Detrick to a private developer/owner (Keenan Development Associates) who in turn undertook to finance, design, construct and operate a private central utility plant on the site. Working in concert with Chevron Energy Solutions Company, a division of Chevron USA, as the co-developer and operator, the Enhanced Use Lessee is providing energy to a varied customer base of high level bio-safety containment laboratories on the Garrison, including the National Institute of Health's National Institute of Allergy and Infectious Disease to the Department of Homeland Security's National Biodefense Analysis and Countermeasures Center. To these federal entities, the financial stability of the operator as well as the experience of its team in designing a plant to meet growing demands as well as dealing with the host of complex legal and business issues involved made the critical difference that assured the Project’s successful completion. The development is designed to be the first phase of a larger facility that will be developed in the future to meet expanding federal and private user demands.
